Terms & Conditions

By using www.nvi.co.in (the “Website”) you agree to be bound by these Terms and Conditions (“Agreement”), whether or not you have registered as a member. This Agreement sets out the legally binding terms for your use and membership and may be modified from time to time without notice; modifications are effective on posting.

By using the Website you represent that you are over the age of 18, have the authority to enter into this Agreement, and are not barred from receiving services under applicable law. If you provide information that is untrue, inaccurate or incomplete, we may suspend or terminate your account and refuse current or future use of the Website.

Each service we provide may have its own terms in addition to this general Agreement.

Term and termination

You may terminate your membership at any time by following the instructions on our Help pages or by written/email notice to us. We may prevent access to the Website and/or terminate your membership at any time, effective on notice to the email address you provided. Liabilities and responsibilities incurred prior to termination survive termination.

Your content

You are solely responsible for any photographs, images, designs, messages or other content you upload, print or publish (“Content”). By posting Content to any public area of the Website you grant us a non-exclusive, worldwide, royalty-free licence to use, copy, display and distribute it for the purpose of providing the service. We may review, edit or remove Content that, in our sole judgment, violates this Agreement or is offensive, illegal, or harmful. We do not guarantee the accuracy, integrity or quality of user Content and are not liable for it.

Purchases, pricing and payment

If you purchase any services on the Website you will be asked to supply information relevant to your purchase, including payment information, which is treated as described in our Privacy Policy. All information you provide to us or our payment processor must be accurate, current and complete. You agree to pay all charges incurred at the prices in effect when the charges are incurred, and you are responsible for any applicable taxes relating to your purchases. Prices and availability are subject to change without notice, and verification may be required before we accept an order.

As a merchant we accept no liability for any loss arising from the decline of authorisation for any transaction where the cardholder has exceeded limits agreed with our acquiring bank.

Delivery

Unless otherwise agreed, delivery is made by Courier/Post to the address you provide. Delivery time is an estimate only and is not a condition of this Agreement. The date of handover to the courier/postal authority is taken to be the date of delivery. Title and risk pass to you on delivery to the courier/post. See our Shipping Policy for more.

Colour reproduction

Colour and contrast on photo books, mugs, prints and other photo gifts can differ from what you see on a screen or on photographic paper, depending on monitor settings and individual/regional preferences. We cannot guarantee an exact match, and you are not eligible for a refund for quality issues arising from this. Our decision on such matters is final.

Limitation of liability and disclaimers

The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, New Vision Imaging disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and does not warrant that the service will be uninterrupted, timely, secure or error-free.

New Vision Imaging will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages (including loss of profits, goodwill, use or data) arising from your use of or inability to use the service, any failure of the software, the uploading of any Content, unauthorised access to your data, or any other matter relating to the service.

You agree to indemnify and hold New Vision Imaging harmless from any third-party claims arising from your breach of these Terms or any representation by you being false or misleading.

Third-party links

The Website may link to third-party sites or resources we do not control. We are not responsible for their content, availability, products or services, and are not liable for any loss arising from your use of them.

Changes and notices

We may modify or discontinue the service, in whole or in part, at any time with or without notice, and we will not be liable to you or any third party for doing so. We may provide notices to you by email, post, or postings on the Website.

Governing law

This Agreement is governed by the laws of India. You irrevocably consent to the exclusive jurisdiction of the courts in the State of Goa, India for all disputes arising out of or relating to use of the Website.
